DONNIE JR GOES TO THE SENATE

Donald Trump, Jr., testified before the Senate Judiciary Committee in a closed session for five hours today. Five hours of answering questions about the June 9 meeting in Trump Tower.

Quick recap. Don Jr. worked with Rob Goldstone and Emin Agarolov to set up a meeting with Russians who promised to deliver dirt on HRC. At first, Don Jr. claimed it didn’t happen. Then it did, but only 4 people were there, including Jared Kushner and Paul Manafort. Then there were 5 people. Then 6, 7, and 8. And it was about adoptions. Then sanctions. Then getting dirt on HRC. Then about her fitness.

Following the testimony, Senator Chris Coons, D of Delaware, sent out the statutes relating to lying to Congress in testimony.

MUELLER WANTS INFORMATION FROM WHITE HOUSE STAFFERS ON TRUMP’S ROLE ON THE STATEMENT ON BEHALF

OF HIS SON ON THE JUNE 9TH MEETING

Remember back in July when news of the June 9 meeting broke, and everyone kept their mouth shut but Don Jr.? Good. Remember how it came out that Donald Trump, Sr. wrote the press releases? Guess who wants to talk to the White House staff members about that weekend?

Robert Fucking Mueller. I don’t think that’s his real middle name, but there are certainly people out there who think it is.

Claiming to have no knowledge of a meeting that took place with representatives of a foreign power in a building with your name on it, a couple floors beneath you, and your son, son-in-law, and long time advisor are in attendance when you’re known as a micromanager is pretty dubious. Claiming that after writing a press release for your son is just flat out lying.

TWITTER RELEASES INFO ON RUSSIAN ACTIONS

Twitter announced today, on the heels of Facebook yesterday, that they will release their internally collected information about how the Russians used its service during the 2016 election. I look forward to hearing more about this.

FBI RESPONDS TO FOIA REQUEST ABOUT BREITBART, HAS 1475 DOCUMENTS. RELEASED 23.

According to Law Newz , the FBI responded to a Freedom of Information Act request in regards to Breitbart. The FBI has 1,475 documents related to them. 23 are able to be released.

Doing the math, that’s 1,452 documents that are classified for one reason or another.

There are a few reasons that these documents can’t be released, like privacy, so jumping to the conclusion that there is an active investigation into them wouldn’t be the only reason that there is a ton of information on them.

But, if I had to put money on it, the FBI has been investigating Breitbart for some time.

Maybe they know why Breitbart has Yandex code in their home page code.

As I’m wrapping this up, I see that the 9th Circuit Court struck down a few parts on the Muslim Travel Ban. I’ll add more about that tomorrow.

Today has been especially crazy.

FACEBOOK SOLD RUSSIAN ADS DURING CAMPAIGN

This is big. Huge. Per the Washington Post, Facebook sold campaign ads to a Russian organization. They claim that $100k was spent by at least 470 fraudulent accounts.

It’s been assumed so for over a year, but having them say so to a Senate Committee makes it an even bigger deal than anyone knew.

DAILY CALLER CALLING IT – PAUL MANAFORT WILL BE INDICTED

The Daily Caller released a report that aides inside the White House believe that Manafort is screwed.

Why is this news?

The Daily Caller is a very partisan, right wing site. This would be like ShareBlue or HuffPo saying HRC was guilty of some evil email stuff.

TRUMP OPENLY ACCEPTING BRIBES VIA GOLF COURSE

USA Today did a ton of groundwork tying together foreign diplomats, lobbyists, and federal contractors to golf trips at Donald Trump’s courses while he was there, and that they were seeking favors from the President.

The President is openly accepting bribes. The fact that this isn’t the biggest story of the year just shows how fucked up things really are right now.

HURRICANE IRMA RAMPING UP

Irma is currently a Category 5, and is hitting Puerto Rico tonight. It’s anticipated to hit Florida on Friday.

TRUMP BACKS DEMOCRATIC DEAL ON HARVEY RELIEF, DEBT CEILING

This one is weird. Trump sided with the Democrats today on Harvey relief and the Debt Ceiling deal. I have two ideas why.

First, Trump is mad at McConnell and wants to spite him.

Second, he thinks doing this deal with Chuck Schumer will get them to stop the Russian investigation.

This may be the dumbest thing he’s done. Until tomorrow. Who knows what stupidity will happen then.

FALLOUT FROM DACA

Following the DACA rescinding, 15 states, and several companies, are suing the President. Leading the charge is New York AG Eric Schneiderman. This isn’t by coincidence. Schneiderman is working with Mueller to deliver a Fuck-Your-Pardon Sandwich with a side of RICO Fries to Donald Trump.

Shits getting interesting. Something big is coming tomorrow.

If it feels like this has been a constant drip of information, I think it’s intentional. I’ll write about why this weekend.

Daily Check-In 9/5/2017

Tuesday after Labor Day. I’m going to make this short.

DACA

Trump announced an end to DACA, affecting about 800,000 Dreamers. Trump sent Sessions out to make the announcement that they would end this in 6 months.

It’s a chickenshit move.

The only good that could come out of this is that Congress might get some actual immigration reform done.

GERRYMANDERING

Senators John McCain and Sheldon Whitehouse filed an amicus brief on Gill vs Whitford . This case is scheduled to go before the Supreme Court, and could set a legal standard for partisan gerrymandering.

KEITH SCHILLER FIRED

Keith Schiller, long time head of Trump’s security team, was fired/let go/quit over the weekend. He’s been with Trump for 18 years, and was involved in Comey’s firing, hand delivering the letter to FBI HQ, even though Comey was in L.A.

Keith knows where the bodies are buried. Because he buried them.

MANAFORT IN EDVA THIS MORNING

I don’t have much else, but supposedly Paul Manafort was seen in the courtroom of the Eastern District of Virginia this morning. Could be that he was testifying at a grand jury, offering a proffer, or getting a cool taco recipe. I’ll update when I find out more.

GTKYG-Pardon Limitations

In this installment of “Get To Know Your Government”, I’m going to talk about something that’s been in the news recently, and is floating around like the Boogey Man.

The Presidential Pardon.

There’s a lot of confusion floating around about what it does and doesn’t do, and what it can or can’t be used for.  Hopefully, this article can answer some questions.

A HISTORICAL PERSPECTIVE

The Presidential Pardon is a power granted by the Constitution of the United States to the country’s Chief Executive, the President.  Not much is laid out in the Constitution itself, but Alexander Hamilton described the Pardon Power in the Federalist Papers #74 as a means of mercy, based on the power of kings to grant mercy as a last resort.  The pardon power can be used at any time EXCEPT IN THE CASE OF IMPEACHMENT.  George Washington pardoned two of the leaders of the Whiskey Rebellion instead of hanging them.

WHAT DOES A PARDON DO

A pardon forgives the crime committed, and removes any criminal penalties of the said crime, for the crimes and/or time period specified in the pardon.

A pardon can only be issued by the executive of a jurisdiction, like a President or Governor.

WHAT A PARDON DOESN’T DO

A pardon is not a “Get out of jail, free!” card.  Accepting a pardon is an admission of guilt, per Burdick vs. United States.

A pardon does not eliminate civil liability.  If someone were pardoned for committing a murder, the family of the victim can come after them in civil court, but could also use that persons acceptance of the pardon as evidence in the civil trial.

A pardon can only be applied to specific crimes listed, not to other crimes committed by the person.  Using the murder example, if it turns up that they also littered as well, they could face penalties for that.  Not the murder, just the littering.

A pardon can only be applied to criminal charges inside of a specific jurisdiction.  Charges for the same or similar crimes can still be brought by an individual state if they were pardoned in federal court, and vice versa.

A pardon doesn’t protect someone from self-incrimination.  Since accepting a pardon is an admission of guilt, and the person cannot be tried for the crime they committed, the person receiving the pardon cannot claim to protect themselves from self-incrimination since they’ve already admitted guilt.  In other words, they waive their Fifth Amendment rights.

HOW DOES THIS PLAY OUT?

Now, we’ve come to the question of the day.  Can Donald Trump pardon himself and his co-conspirators?

Short answer:  No.

As I’ve described in Lateral Movement, Nixon already asked if he could pardon himself.  This brief describes what his legal team determined.  Short version, a President cannot pardon themselves nor their co-conspirators, as doing so would put them above the law.

Is there a case on this which answered the question?  No.  We are in uncharted territory.  Courts don’t rule on hypothetical cases.  The idea that a President would not only be so corrupt that they would commit multiple crimes, but that they might try to pardon themselves was unthinkable by the Founding Fathers.  They anticipated some corruption, but this level was unfathomable.  There was no need to codify the pardon powers then because they didn’t think it would be needed.  Sort of like the warning on a bottle of Windex that says “Do not spray directly into eyes.”

Let’s assume for a moment that Donald Trump’s legal strategy consists of pardoning himself and his co-conspirators.  First, if it’s involved with an Impeachment, no can do.  A presidential pardon cannot be used in cases of Impeachment.  There are some fine hairs that need to be split, but the two main questions are at what point does Impeachment begin, and are all crimes in an impeachment non-pardonable, or just the Impeachment process of removing a person from office?

Here’s my prediction.  And by mine, I stole part of this from @AltScalesofJustice.  Things are going to come to a head.  Criminal indictments will be served to Trump’s staff, family, and President Donald Trump.  Donald Trump will pardon himself.  Maybe his family, but definitely himself.  This pardon will immediately be challenged in the Supreme Court.  In a unanimous decision, (Maybe 8-1 or 7-2 at the weakest, but the SCOTUS would want to make a statement with this) the Supreme Court would rule that no one, especially the President of the United States, is above the law.  By attempting to pardon himself, Donald Trump attempts to circumvent Due Process, and place himself and his co-conspirators in an extra-judicial position.  The SCOTUS puts a restriction on the pardon power, Trump tries to fire back at the SCOTUS, and Trump is then removed from office.

WHAT IF THE PARDON SURVIVES SCOTUS REVIEW?

So, let’s assume for a moment that the SCOTUS rules 5-4 that the President can pardon themselves.  What then?

In that case, Donnie’s fucked 8 ways from Sunday.

If he leaves out one co-conspirator, they’ll turn on him faster than a fidget spinner.  They will turn states evidence for whatever state indicts him first, second, third, fourth, and fifth.

Next, he’ll get impeached and removed from office as fast as the Senate can move.

Once he’s removed from office, here come the State Indictments.  He pardoned himself of Federal charges, not State charges.  New York will own his ass.  Literally.  Enterprise Corruption is the state statute of RICO.

While he’s facing hell from at least 39 states (all of the ones that had their voting systems hacked on his orders), the Feds will come at his with a Civil RICO charge.  Using his pardon as evidence against him, the government will seize his assets.  All of them.

It gets worse for Donnie.  Remember all of those crimes he pardoned himself for?  He can be subpoenaed to testify in court about each and every one of those, and what he did, who he worked with, and why.  And he can’t refuse an answer, since he has no rights to avoid self-incrimination.

So, in short, instead of dying in Leavenworth, penniless and infirm, he’ll die in Riker’s Island, or in Chino, or in any other prison, penniless and infirm.
